Gitruck Toolbox Terms of Service

1. Introduction
Welcome to Gitruck Toolbox (同合智创工具箱, the "Toolbox"), a collection of web-based creative tools for images, video, audio and subtitles, provided by Guangzhou Tonghe Shantian Culture Media Co., Ltd. and its affiliates ("we", "us"). Most tools are processed by the Gitruck Cloud engine on our servers; a few run entirely in your browser.
The Toolbox is the web interface you use; Gitruck Cloud is the cloud service that processes your tasks. When you run cloud tasks through the Toolbox, you are also bound by the Gitruck Cloud Engine User Agreement. These Terms add rules specific to the Toolbox (sign-in, tool usage, and the permitted use of features such as watermark removal). For billing, accounts and availability of the cloud service itself, the Gitruck Cloud Engine User Agreement prevails if the two conflict.
Please read these Terms carefully, especially the provisions that exclude or limit our liability and the rules on content and watermark removal. If you do not agree, stop using the Toolbox. By signing in, submitting a task or otherwise using the Toolbox, you agree to these Terms.
2. Accounts and sign-in
2.1 The Toolbox uses your Gitruck Cloud account, which you can sign in to with WeChat or Google. It shares the same account, credit balance and API key with the Gitruck Cloud console and the gtrk CLI. An account is created automatically the first time you sign in.
2.2 When you sign in with WeChat or Google, you must also comply with their terms. We do not control whether a third-party sign-in service is available or stable in your region; if one is unavailable, use the other.
2.3 Your session is stored in your browser, is valid for 30 days and renews while you stay active. Keep your devices and API key secure, and sign out after using a shared or public device. You are responsible for all activity under your account, including submitted tasks and credits used. If you notice unauthorised use, sign out of the affected devices and contact us immediately.
2.4 Signing in with WeChat and with Google creates separate accounts; we do not merge them automatically based on email or other information.
3. Using the service
3.1 Tools labelled "Runs on cloud" upload the files you submit to our servers for processing; tools labelled "Runs in browser" process files locally and do not upload them.
3.2 Cloud tasks are queued and processed asynchronously. Processing time depends on file size, task complexity and queue length. Progress and time estimates are for reference only; we do not guarantee any specific processing time.
3.3 Results are kept on our servers for about 60 days and then deleted automatically. The Toolbox is not a storage or backup service; download the results you need and keep your original files. Task records saved in your browser may be lost if you clear browser data or change devices.
3.4 The Toolbox is designed for manual use. You must not use scripts, crawlers or other automated means to call the Toolbox web pages or their endpoints in bulk; use the gtrk CLI or the Gitruck Cloud API for batch or automated processing.
3.5 Tools marked "Beta" or "Coming soon" may change in features, parameters, output formats or pricing, or be withdrawn.
3.6 You must not reverse engineer, interfere with or disrupt the Toolbox or Gitruck Cloud, circumvent billing, forge or misuse credentials, bypass limits, or illegally obtain data of the platform or other users.
4. Content rules and AI-generated content
4.1 You must ensure that everything you upload, process or generate complies with the laws of the People's Republic of China and of your location. You must not process content that endangers national security; promotes terrorism, extremism or ethnic hatred; contains obscenity, pornography, gambling, violence or incitement to crime; insults or defames others or infringes their reputation, likeness or privacy; infringes copyrights, trademarks or other intellectual property; or is otherwise prohibited by law.
4.2 The Toolbox only provides technical tools. You are primarily responsible for the legality of the content you process and generate.
4.3 Watermark, subtitle and logo removal. These features may be used only on material you own or are authorised by the rights holder to modify (for example, removing old subtitles from your own work). You must not use them to remove copyright notices, author credits, platform watermarks or other rights-management information from others' works in order to hide the source, pass off the work as your own or avoid licensing, nor distribute the results in an infringing way. You are solely responsible for any dispute arising from a breach of this section. We may delete related data and suspend or terminate the service when we discover a breach or receive a notice from a rights holder.
4.4 If you use AI generation, deep synthesis or voice cloning, you must clearly label synthetic audio or video when publishing it, as required by law. You bear any penalty or dispute arising from failure to do so.
4.5 When using features that generate speech from a reference voice, you confirm when submitting the task that the reference audio is your own voice, or that you have informed the person whose voice it is and obtained their separate consent, and that you will not use the generated speech to impersonate others, commit fraud or create false information.
4.6 You assess and bear the risks of using results commercially (including copyright, privacy and regulatory risks); we are not jointly liable.
5. Intellectual property
5.1 We own the intellectual property in the Toolbox and Gitruck Cloud, including brands, web design, software, algorithms and documentation. You may not use them without our written permission.
5.2 Your content remains yours. To run the tasks you submit, you grant us the minimum rights needed to receive, temporarily store, process and return the results to you. Except as required by law or for security, we will not use your material or results commercially, share them publicly, or use them to train any model.
5.3 You warrant that you own, or are fully authorised to use, all material you upload.
6. Credits and fees
6.1 Some tools are free; others consume credits according to the Gitruck Cloud price list. Each tool shows the credits required before it runs; the price shown when you submit applies.
6.2 If a task fails, credits already reserved for it are refunded according to Gitruck Cloud's billing rules.
6.3 Top-ups and invoices are handled in the Gitruck Cloud console under the Gitruck Cloud Engine User Agreement. When your balance is insufficient, cloud tools cannot accept new tasks.
7. Breach
7.1 If you breach these Terms or the Gitruck Cloud Engine User Agreement (in particular the content rules and section 4.3), we may, depending on the severity, warn you, restrict use, delete infringing data, suspend your API key or close your account.
7.2 You will resolve, and fully compensate us for all direct and indirect losses arising from, any third-party complaint, lawsuit or regulatory penalty caused by your breach.
8. Disclaimers and limitation of liability
8.1 The Toolbox is provided "as is". We do not guarantee that it will meet your specific needs, produce particular results, or be uninterrupted or error-free.
8.2 Results of AI and algorithmic processing (such as watermark removal, subtitle recognition and canvas adaptation) depend on the quality and content of your material and may contain residue, mistakes or differ from your expectations. Please preview results before relying on them.
8.3 To the extent permitted by law, we are not liable for interruption or data loss caused by force majeure, including government action, natural disasters, cyberattacks, telecommunication failures and outages of third-party sign-in services.
8.4 Except where mandatory law provides otherwise, our total liability to you under any theory shall not exceed the fees you actually paid us for Gitruck Cloud services in the twelve months before the event giving rise to the claim.
9. Changes and termination
9.1 We may add, change or withdraw tools for operational or technical reasons and will try to announce changes on the Toolbox in advance.
9.2 You may stop using the Toolbox at any time, or ask us to close your account as described in the Gitruck Toolbox Privacy Policy. Please make sure there are no running tasks or open disputes first.
10. General
10.1 These Terms are governed by the laws of the People's Republic of China.
10.2 Any dispute shall first be resolved through friendly negotiation; failing that, you agree to submit it to the People's Court of Tianhe District, Guangzhou.
10.3 We may update these Terms; continuing to use the Toolbox after an update takes effect means you accept the revised Terms.
10.4 If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
10.5 If the Chinese and English versions differ, the Chinese version prevails.
